www.ostoja-Wilanów.com (“Site”) is owned and operated by Fadesa Polnord Polska Ltd, with headquarters in Warsaw, Al. Jerozolimskie 94, 00-807 Warszawa, entered in the Register of Business run by the District Court for the capital city of Warsaw XII Economic Division, KRS (Polish Company Register) no. 0000235595 (henceforth referred to as “FPP”).
1. Conditions of using the Website
1.1. All rights to the Site, including the right to its text and graphic elements, page layouts and other elements, are reserved unless explicitly stated otherwise.
1.2. By using the information presented in the Site, users do not acquire any intellectual property rights to any works or databases included in the Site.
1.3. The works and databases included in the Site may be used only within the scope of permitted use, as specified by the provisions of the Copyright and Related Rights Act of 4th February 1994 and the Database Protection Act of 27th July 2001. In particular, other than the exceptions specified by the above-mentioned legislation, users are not permitted to copy, modify, electronically transmit or use in any other way for commercial purposes any parts of this Site, in whole or in part.
2. Reliability disclaimer
2.1. The aim of the Site is to provide the user with general information about the services offered by FPP, in particular about the building investments of FPP.
2.2. The data published in the Site is for information only and does not constitute an offer as understood by the regulations of the Civil Code.
2.3. Even though all efforts have been made to secure the reliability of information provided, there is a risk of inaccuracy. FPP shall not bear responsibility nor guarantee the accuracy and completeness of the information presented in the Site.
2.4. The information about availability of flats, as presented in the Site, is updated regularly. However, due to technical limitations, the latest information about the availability of a particular flat can only be provided by a sales office.
2.5. FPP shall not bear responsibility for any failure in access to the Site, or any information, computer software or any other content included in the Site, nor for any other errors, shortages, computer viruses or any other electronic signals which might jeopardise the user. Moreover, FPP disclaims any warranty, explicit or implied, including implied by conduct warranties concerning sale and suitability for a given purpose, within the broadest scope permitted by the law.
2.6. In no circumstances shall FPP, companies related with FPP, or its partners and agents, or employees of FPP or of companies related with FPP, bear any responsibility for the users or any other persons, for any decision or action taken on the basis of the information provided in the Site, or due to any indirect, particular or collateral damage, even in the case of obtaining information about the risk of their occurrence.
2.7. Some of the links in the Site refer to servers and websites administered by third parties for which FPP shall bear no responsibility. FPP does not bear responsibility for the information provided by such servers and websites, in particular for their legality.
2.8. FPP reserves the right to change the data and information provided in the Site at their own convenience, without prior notification to the users of the Site.
3. Privacy protection policy
3.1. By filling in question forms or ordering newsletter subscriptions on the Site, users make their personal data - such as name, surname, email address, home address, or phone number - available to FPP. In compliance with article 24 of the Privacy Protection Act of 29th October 1997, we would like to confirm that providing personal information is not obligatory. In case of obtaining the users’ permission, their data will be processed by Fadesa Polnord Polska Ltd, with headquarters in Warsaw, Al. Jerozolimskie 94, 00-807 Warszawa, solely for marketing purposes, to contact the users by means of the Site and electronic mail, and, if phone number and address have been provided, by phone and mail. In case of obtaining the users’ permission, the data may be transferred to other subjects in Poland, in order to carry out particular tasks related with FPP.
3.2. FPP does not pass on, sell or lend personal information from users of the Site to other persons or institutions, except with the explicit permission or request of the user, or if it is demanded by the law in force. Users have the right to access their data, and to request its change.
3.3. FPP uses appropriate technologies and introduces internal procedures to maintain the security of users’ personal information, and to prevent unauthorised access to such information. Collected personal data is treated as a separate database, stored on a server in a special safety zone, with limited access.
3.4. FPP uses “cookies”– small text files placed on the users’ computers and used during connection to the Site. Cookies are used to investigate the movement of users on the Site, which makes it possible to learn their preferences better. They are not used by FPP to identify or analyse the movement of particular users. Most internet browsers enable users to remove cookies from their computers or to block their acceptance. Blocking cookies sent by the Site should not cause problems in using the majority of its content. 3.5. Other websites, both those accessed through the links in the Site and those which add the link to the Site, may use other privacy protection regulations. FPP recommends checking the regulations of the sites in question.
